Release and Indemnity
READ CAREFULLY BEFORE ELECTRONICALLY SIGNING

In consideration of my participation as an adopted athlete in the North America Sports, Inc. (“NA Sports”) Adopt an Athlete Program (the “Program”) which is sponsored by NA Sports, I agree to assume the risks incidental to such participation, and on my own behalf and on behalf of my heirs, executors and administrators, I hereby release and forever discharge the Released Party named below, of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with my participation in such Program, and further agree to indemnify and hold each of the Released Parties harmless against any and all such liabilities, claims, actions, damages, costs, or expenses including, but not limited to, all attorney's fees and disbursements. For this Program, the “Released Party” is NA Sports and its officers, directors, employees, agents, representatives, successors, and assigns. I understand that this Release and Indemnity Agreement includes any claims based on the negligence, action or inaction of the Released Party and covers bodily injury (including death) and property damage suffered by me as a result of my participation as an adopted athlete in the Program. I declare that I have the skill level required to participate in this Program. I further authorize medical treatment for myself at my cost, if the need arises.

I further grant the Released Party, the right to photograph and/or videotape me and further to display, use and/or otherwise exploit my name, face, likeness, voice, and appearance forever and throughout the world, in all media, whether now known or hereafter devised, throughout the universe in perpetuity (including, without limitation, in online webcasts, television, motion pictures, films, newspapers, and magazines) and in all forms including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes or for any other purposes whatsoever, without compensation, reservation or limitation. The Released Party is, however, under no obligation to exercise said rights herein granted.

This Agreement shall be governed by the laws of the State of Colorado, and any legal action relating to or arising out of this Agreement shall be commenced in the State of Colorado. I certify I am 18 years of age or older.

In consideration of our organization’s participation by hosting a adopted athlete in the North America Sports, Inc. (“NA Sports”) Adopt an Athlete Program (the “Program”) which is sponsored by NA Sports, the organization named on this form (the “Organization”) agrees to assume all risks incidental to such participation in the Program, and on its own behalf and on behalf of its officers, directors, agents, shareholders, employees, volunteers, successors, representatives, assigns, the teacher employed by the Organization hosting the Adopted Athlete, any of the Organization’s student or his/her guardian or their heirs, executors or assigns (collectively the “Releasors”) participating in the Program hereby releases and forever discharge the Released Party named below, of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with the Organization’s participation in such Program, and further agrees to indemnify and hold each of the Released Parties harmless against any and all such liabilities, claims, actions, damages, costs, or expenses including, but not limited to, all attorney's fees and disbursements. For this Program, the “Released Party” is NA Sports and its officers, directors, employees, agents, representatives, successors, and assigns. The Organization understands that this Release and Indemnity Agreement includes any claims based on the negligence, action or inaction of the Released Party and covers bodily injury (including death) and property damage suffered as a result of the Organization’s participation in the Program.
